Ofcom has fined another porn site operator - in Cyprus, I think - £600,000 under the UK's #OnlineSafetyAct.

I'm struggling to think of another regulatory regime where the fines have flowed so rapidly.

(Or, I anticipate, where so few will be paid.)

    Just a moment...

@neil Yeah, before I saw you last sentence I was gonna ask "have any of these fines ever been paid?"

@TimWardCam @neil I wonder how/if these firms even account for these fines.

As a company registered in a foreign jurisdiction, they will almost certainly file annual accounts which might even be audited. Does a fine like this appear as a liability on the balance sheet even? Does a 'provision' get made for it?

Or it it just literally "you can't enforce this" so it's not a liability at all.

@bloor @neil There might just be a line in the annual accounts each year "there are always various foreign legal cases going on, but investors don't need to worry about them."

@neil are there even consequences for not paying when they fine entities outside the UK (except being blocked)?

that doesn't seem to be very different from how the chinese government was demanding eg. google to "comply with laws of china"

Yes, it does. Ofcom helpfully even gives the URLs of porn sites that don't do age-verification.

Whisper who dares, but could #Ofcom be deliberately making a mockery of this unenforceable Act?

@neil OFCOM's enforcement is entirely performative and overblown.

Rather like some of the content they're fining overseas orgs for, but without the alleged happy ending.

@neil if a company has no presence in the UK at the time of the fine bit then opens a local subsidiary, is that subsidiary liable for a fine levied before it even existed?

@neil I'm still a bit confused how one can fine a company that has an online presence but does not operate in your country? Can you ELI5 that? That your contry can access the internet does not mean you have juristiction over all content there?

@neil I think Ofcom may be trying to make a not-very-subtle point to .gov.uk that their cunning plan isn't working.
