    Finally had a chance to read Sotomayor’s dissent from the shadow docket order. She was joined by Kagan and Jackson, so all six of the justices in the tank for Trump and Republican Fascism were on board with stopping an election already underway. The Roberts Court vacated a federal district’s injunction against an Alabama voting district map the lower court found to be unlawful on two grounds: violation of section 2 of the Voting Rights Act and violation of the 14th Amendment because the map was the product of intentional racial discrimination. 2/

        The Roberts Court’s recent decision in Callais only pertained to the section 2 of the VRA, not to claims of intentional racial discrimination violative of the 14th Amendment. So, even if the district court’s injunction should not survive Callais, it should remain in place because of the 14th Amendment. 3/

          As Sotomayor emphasizes, Callais firmly announced that it did not apply to cases of intentional racial discrimination. In fact, in Callais the Roberts Court specifically announced that its decision did not overrule Allen - and its vacatur is in Allen! 4/

            Let this sink in: the Roberts Court used the shadow docket to vacate a judgment in a case the Roberts Court just told us it was not overruling. If this sounds nuts, it is because it is. 5/

              Sotomayor’s dissent is a roadmap for how the district court could decide Callais is irrelevant. But the remand and possible appeals will take time. Meanwhile, the election in Alabama has been thrown into “chaos and confusion.” So however the litigation process unfolds, the Roberts Courtd has again interefered with an election. 7/7

                @heidilifeldman Let's face it.... This Christo-fascist SCOTUS wants all future elections to be decided in court, ultimately their court. It's a power grab because they think they can get away with it...

                  @lednaBM @heidilifeldman this has been the GOP’s open and obvious and stated goal for almost my entire adult life and DEMs have known this and done pretty much zero to combat or address it. Why? Who knows.

                    @bucachowchow @heidilifeldman

                    It's because religion poisons everything. Ask yourself how many friends, relatives, and generally good people will tell you that Jesus was a loving, peaceful, and nice guy? It's nuts. His religion is coercion. Worship and love me or burn forever. Blaspheme their supernatural holy spirit and burn forever. Christians hate themselves and hate the natural world. Good or bad, they grovel before an imaginary fucking king instead of working at democracy, freedom, and etc
