Agi: Bimba investita all’asilo di Velletri: sentenza definitiva per la maestra
AGI - Dopo 8 anni di processo, dopo circa 30 udienze, dopo sofferenze e umiliazioni subite nel corso del processo stesso, siamo arrivati oggi alla condanna definitiva per la maestra Francesca Rocca che si è vista respingere il suo ricorso in Cassazione dopo due sentenze definitive in primo e secondo grado. Per lei due anni e sei mesi di reclusione per lesioni personali colpose e abbandono di minore. Condannata in via definitiva anche l'investitrice Chiara Colonnelli che non aveva però fatto ricorso in Cassazione: un anno di reclusione per lesioni e un anno di sospensione della patente. Così in una nota Massimo Montebove e Lara Liotta, genitori di Lavinia, la bambina di 16 mesi investita nel 2018 nel parcheggio dell'asilo nido che frequentava a Velletri, in provincia di Roma.
In questa vicenda - sottolinea la famiglia - l'unica, vera persona condannata a vita è nostra figlia Lavinia che era nata sana e che resterà tetraplegica e in stato vegetativo di minima coscienza per sempre. Voglio ricordare che i giudici nei dispositivi delle sentenze hanno scritto nero su bianco che mai le imputate, oggi definitivamente condannate, hanno mostrato segni di pentimento. Vogliamo ringraziare i magistrati per essere arrivati finalmente ad acclarare processualmente la verità dei fatti e vogliamo ringraziare soprattutto il nostro avvocato Cristina Spagnolo per essere stata al nostro fianco fin dal primo momento e per averci sostenuto anche psicologicamente.
La conferma delle condanne e la situazione di Lavinia
Il 27 marzo 2025 la Corte d'Appello di Roma aveva confermato le condanne di primo grado per le due imputate: Francesca Rocca (la maestra) condannata a 2 anni e 6 mesi e Chiara Colonnelli (la donna alla guida dell'auto) condannata a 1 anno con sospensione della patente. Oggi la parola fine della Cassazione dopo il ricorso della maestra. Lavinia compirà 8 anni il 15 marzo, vive oggi a casa in stato vegetativo di minima coscienza, è assistita h24 da medici, infermieri, terapisti e famiglia sotto la supervisione della ASL di Velletri e dell'ospedale Bambino Gesù.Baby hit at Velletri kindergarten: final judgment for the teacher
AGI – After 8 years of trial, after approximately 30 hearings, after suffering and humiliation endured during the trial itself, we arrived today at the definitive sentence for teacher Francesca Rocca, who saw her appeal dismissed at the Court of Cassation after two definitive sentences in the first and second instance. For her, two years and six months of imprisonment for negligent injury and abandonment of a minor. The driver, Chiara Colonnelli, was also definitively sentenced, but did not appeal to the Court of Cassation: one year of imprisonment for injury and one year suspension of her driver’s license. This is according to a note from Massimo Montebove and Lara Liotta, the parents of Lavinia, the 16-month-old girl who was hit in 2018 in the parking lot of the nursery school she attended in Velletri, in the province of Rome.
In this case – the family emphasizes – the only, true person condemned for life is our daughter Lavinia, who was born healthy and will remain tetraplegic and in a state of minimal consciousness for ever. I want to recall that the judges in the rulings wrote in black and white that the accused, now definitively condemned, never showed signs of repentance. We want to thank the magistrates for finally establishing the truth of the facts through the legal process and we want to thank especially our lawyer Cristina Spagnolo for being at our side from the beginning and for supporting us psychologically as well.
The Confirmation of the Sentences and Lavinia’s Situation
On March 27, 2025, the Court of Appeal in Rome confirmed the first-instance sentences for the two defendants: Francesca Rocca (the teacher) was sentenced to 2 years and 6 months and Chiara Colonnelli (the driver) was sentenced to 1 year with suspension of her driver’s license. Today, the Court of Cassation has put an end to the case after the teacher’s appeal.
