Y’all, I want to talk about beans. And capitalism. And stupidity and greed. You know, the American Way.

Now Bean Clubs, ie people who trade beans, have been around forever. US clubs as far back as the 1800s, and the 4H Club has had an active Bean Club since the 1930s.

But #RanchoGordo has expensive beans for rich white people, and copyrighted the term #BeanClub, and is threatening to sue anyone who uses the term. This has got to be one of the stupidest copyright claims I have ever seen.

They have literally sent cease and desist letters to heirloom bean growers and distributors.

Y’all, beans. We’re talking about beans. Late stage capitalism is so goddamn stupid. I’m tempted to go start a porn site called BeanClub, just for the giggles of it.

@MissConstrue It gets even better. From the Wiki article:

"Steve Sando was a former web designer, Jazz radio DJ, and wholesaler of Esprit clothing, when he burned out, moved to Napa, and decided to grow heirloom tomatoes despite having no experience in agriculture..."

*kids singing "G-R-I-N-G-O" around the campfire*

"Sando founded Rancho Gordo in 2001... Around this time, Sando gathered bean seeds from Seed Savers Exchange, incorporating varieties of beans from Oaxaca, Mexico."

        @MissConstrue
Once, a long time ago, when I was working in a retail shop, the store next door had a shoplifting problem. We had a code word for when my neighbor thought someone was about to run, and I’d come stand by the door.

Well, one day she called, and I came right over. Not in time, a shoplifter ran right past me empty-handed, but her friend came behind her acting suspicious and awkward. I grabbed the second girl by the wrist and held on. She couldn’t have weighed more than 97 pounds soaking wet, so keeping hold of her wasn’t difficult. At the same time, I called the police on my cell phone with my free hand.

Just a few seconds after the dispatcher answered, two “ladies” jumped out of a car in the parking lot and started telling me I couldn’t hold this young woman there. This girl was almost certainly the friend her accomplice planned in advance to abandon if things went bad... Which, of course, is exactly what happened.

Then these ladies suddenly claimed they were lawyers and insisted the law said I couldn’t stop someone from leaving. So I turned on my speakerphone with the 911 dispatcher still on the line and asked, “Am I allowed to hold this suspected criminal here if she isn’t being harmed in any way?”

The dispatcher replied, “Yes, and tell those other two to wait there too.”

At that point, they must have gone back to their car to get their lawyer credentials, only to realize they’d conveniently left them at home, because they drove off pretty quickly.

Funny how that happens. A lot of people think they’re lawyers until they realize they probably couldn’t even talk their way through daytime court TV, much less defend what they’re saying.

I'm just saying, it would be a funny day in court, if it ever got that far, if they're suing for beans, and all you have is beans.

Edit: OH, and there probably already is a porn club called bean club/club bean. It's a dirty euphemism after all.

It's a weak claim which is very unlikely to succeed based on the description in the article. The other bean clubs should stand their ground, but seemingly do not want to call the bluff. That's their choice in the end, I suppose, but this happens a lot in trademark law.

This is no different than the general situation of any rich person getting more justice than a poor person.

Inside the Food World's Secret Society: Bean Clubs

Bean clubs by companies like Rancho Gordo have become popular among people in the food taste-making set.

These other bean clubs should threaten to invalidate Rancho's trademark. That will probably shut Rancho up pretty quick. However, it requires the will to fight.

@MissConstrue funny thing is, the second someone stands up to them and says "ok, let's legislate this", Rancho Gordo will realise that there's an overwhelming chance the court will rule that the trademark should never have been granted and back the hell off so quietly...

we can but hope a patents lawyer decides to start a bean club at some point

@MissConstrue that’s a trademark, and good luck to Rancho defending that. Where can I find a non-Rancho affiliated bean club in my area?

@MissConstrue if you started a porn site, I would never see it because the state of Missouri requires age verification and that ain't going to happen.
