Sounds to me as if both sides are wrong here. The initial strategy to attract investors with OpenAI switching from a non-profit structure to a profit-motivated one was more than Musk could feasibly handle.
Why did OpenAI (and Microsoft) get sued specifically by the richest person in the world? Musk is an eccentric. Some would also say that he is a dangerous individual in light of his alliance with Donald Trump/advancing the DOGE Department — and that Musk is not any different than the Howard Hughes or John D. Rockefeller of our time.
The way that Altman treats his employees leaves a fair amount of open questions. I really do not see how anybody who is a big fish or CEO wins in these sorts of accusatory lawsuits. With any company, they know that questions are brought up about control, steering money to projects so that growth can occur and sales efforts will do better, and improving brand recognition.
I think Altman has lost control of OpenAI's core mission. I also think that if Musk wins this lawsuit then he will consolidate all of OpenAI's operations into Musk's xAI brand and this online boondoogle will be 3X worse in terms of what the real-life deliverables are.

@iamnickw I'm not sure whether I would agree that Musk is wrong. Yes, his motivation is likely the oversized, bruised ego, but that doesn't change the letter of the law.
As for Musk getting control, I don't think he wants to. That would be admitting that Altman was better than him and xAI. I think he wants to stop OpenAI's IPO plans, so that SpaceX/xAI will be an even bigger deal. Not just for the money, but also so he gets the title of the biggest IPO ever.

I wouldn't hold my breath that Congress is doing anything about the lying under oath. After all, OpenAI sponsored the ballroom. -
