It seems wildly different to other lawsuits against AI companies, the existing litigation looks closer to traditional publisher liability than these facts. But I have to think that some court would see past that, essentially saying "you can't have your cake and eat it, too." I think the case would have to be more direct injury that the one cited, though. Not "they used OpenAI and I got injured" but "I used OpenAI and I was injured."
